1. Jeremiah Dial Sr.

(Listed as a Patroit in the Revolutionary War--S.A.R. File 64526 His Willestablishes his death date and names heirs. Tombstone is in Gilders CreekCemetery (Newberry Co., S.C.) Jeremiah Jrs statement in W-914 (pensionrequest) sets date of entry in Colonies as 1772. Spelling of name hasbeen Dial, Deal, Diel, Dyal, and Doyel, but always returns to Dial.Probably Scottish (Covenater religion). I surmise Scottish because ofreligion and not Irish because they were listed as Protestants which notmany Irish are. I put Jeremiah Srs. year of birth to be about 1730 andnot 1720 as many others have. My reason being his age in 1779 whenJeremiah Jr. served 90 days for his father in War, and age at birth oflast child 1781. Birth year of 1730 (same year of birth of wifeMargaret) just works better for me. I use Sr. and Jr. to seperate fatherand son based on Newberry petit jury rolls from abt 1795 where they areso identified.

The above land grant is based on 100 acres for head of house and 50 acresfor each child. John, Jeremiah Jr., and Sally. 100 acres for head ofhouse included wife. By the dates of the three land grants to Jeremiah,William, and Margaret it would appear that Jeremiah, Margaret, and threesmaller children arrived ahead of William and Margaret who came on LORDDUNLUCE in December 1772. I believe William and Margaret came withrelatives (As yet unproven) Montgomery.
I list Jeremiah Dial Sr. as being born in Ireland (As does everyone) butI have read the dates off the Scots, English, and Wales migration and canfind nothing to pinpoint a time for the Dial family to have arrived. TheCovenator preacher (Martin) who brought the five shipload of settlers toCharleston, was in fact born about the same time as Jeremiah was inScotland and didn't come to Ireland until 1742, just 30 years before therelocation. I have never found the name Dial on any Irish document orlist of Irish names.

Newberry District {} In the name of God Amen- - --I, Jeremiah Dial of the State and District
aforsaid being weak in body but of sound sense and memory and calling tomind the mortality of all
flesh, and knowing that it is appointed of God for all men once to die domake this last Will and Testa-
mant in the following manner (VIZ) first and principally I recommend mysoul to God and my body to the
earth to be buried in a decent and christian like manner at thediscretion of my Executors hearafter
named, and such property or goods and chattels as it has been pleased Godto bless me with, I give
devise and dispose of as follows, first I give and bequeath unto mybeloved wife Margaret Dial the one
third part of all my estate both real and personal to her and to be ather disposal forever- - - - - - -
Secondly I give and bequeath unto my grand daughter Margaret Dial Onehundred dollars to be paid her

Margaret Montgomery

Margaret is named in Will as wife. Her age, death date, and place ofburial are taken from her tombstone in Gilders Creek Cemetery. Her nameis spelled Margaret Diel. Age at birth of last child is set at 51. BeforeElizabeth Dial of Georgia went to Gilders Creek Cemetery and confirmeddeath date and age at death of Margaret Dial I had been researchingMargaret for her maiden name and the possibility of her being a secondwife. I based the second wife theory on years between 1st and lastchild. (30 years) and years between 5th and 6th child.(15 years) AlsoJeremiah Jr. stated in pension request that he came to Colonies with hisfather (not family) and that one battle was fought 5 miles from myfathers house.(not parents) I am now sure that Margaret was only wife ofJeremiah Sr. Now for the name Lavender that has been added to her nameas a maiden name. The name William (son) is listed as heir in 1805 will,and William Lavender is listed with David Montgomery as executators. Aresearcher (left unnamed) decided that these two Williams were the sameperson and deemed that by William ( 1st son ) having middle name ofLavender that made Margaret's maiden name Lavender. I have found noevidence to support this claim, in fact I haven't found Margarets nameanywhere except the 1805 will of Jeremiah Sr. My research doesn't goback beyond Jeremiah Sr., but for some future researcher who might travelinto the Ireland connection, I would offer my suggestion on a possibilityof Margarets maiden name. That name would be Montgomery. I base this ontwo simple facts. The Montgomerys have a close tie to the Dials and thedates on the three seperate land grants. I think William and Margaret(daughter) came on LORD DUNLUCE, December 1772 with relatives andJeremiah Sr., Margaret (wife) and three minor children came about 45 daysearlier on another one of Rev. Martins five ships. The Montgomery on theLORD DUNLUCE ends up with a land grant next to Jeremiah Srs land grantissued 45 days earlier. Still I have no concrete evidence to back thisclaim, only theory.

Margaret Dial (Widow of Jeremiah Dial) sell and grant David Dial andJeremiah Dial, her 1/3 pcrt of acres on Indian Creek----left her by willof her late husband.
February 2000 is the time I decided to go with the name Montgomery forMargaret. I have talked it over with several Dial researchers and theyagree that even tho I don't have proof such as a will or other documentsthat I certainly have a better case than the persons who put Lavenderforward as her maiden name. I first tried to chase the name of Lavenderto its source to find the proof that was offered and found the source ofthe information and also a person who later provided back up informationfor the original person. I will not disclose the names of the otherresearchers. The original Lavender tag was applied by a person who tookthe Will of Jeremiah Dial in 1805 and decided that the Exec's of Willwere people mentioned in the Will and that Dial had been left off oftheir name in writting. Thus wife Margaret became Margaret Dial, DavidMontgomery became David Montgomery Dial, and William Lavender, becameWilliam Lavender Dial. They then took the liberty of assuming that ifson William's middle name was Lavender that it stood to reason that hewas named for Margaret's maiden name.
The second person flatly stated to me that she was named in the 1805Will as being named Lavender. Statement was widow is named as Lavender. Ihad looked at this Will thousands of times but mostly in a transcribedtext because the old handwritten copies are hard to read very fast. Ihad never seen this statement but was willing to obtain an original copyfor study. For the people that have studied the Will they know that itis a long document that actually covers a period in 1805 and isn't proveduntil 1817 when Margaret dies. I went over the document on a copy on theLDS tape library and could not find Margaret as being named a Lavender. Idid find the statement and I will admit that if you are looking forsomething and you find a word that you can see in it what you are lookingfor then your mind may accept that word as you would like it. Thestatement turned out to be Margaret is name as purchaser. Typed itdoesn't look anything alike but handwritten in the old style it wasn'treadily readable and took some study to construct the right word.
As futher proof I had some of the original notes of CharlesCollisson and the findings of Hastings Harrison MARTIN DIAL AND RELATEDFAMILIES, and they both either put a question mark or unknown in thespace for lasr name of Margaret. I might mention that the name of JohnDial's wifes name is also in question in my mind and that her name alsohas a question mark after Montgomery in her name.
Now for my explanation: By establishing the difference in timebetween the land grant to Jeremiah and those of Willim and Margaret itappears that they arrived on different ships in Rev. Martin's group.
I think that William and Margaret came with relatives, and the relative Ipick is one who is later mentioned in the 1805 Will. None other thanDavid Montgomery (older). I put older to seperate him from a later DavidMontgomery (younger) who will be in area and will be confused in Will byresearch of earlier researchers.
Research into Newberry Co. records show brothers and sisters ofDavid Montgomery and he does have a sister named Margaret (amomg 4 named)and a brother Hugh among others. I have not researched the Montgomerysbut I believe David Montgomery (younger) to be son of Hugh. DavidMontgomery (younger) and Jane Beard Montgomery are buried next tooJeremiah and Margaret Dial in the Gilders Creek Cemetery in Newberry Co.,S. C. I think this is futher proof that the two famialies are
related.
In 1803 just two years before his death Jeremiah Dial and DavidMontgomery (older) purchased 100 acres next to Dial place bringing it toa total of 254 ? acres. There is no records I can find where David
Montgomery quits this property except in his capacity as exec. of Will heallows it into heirship of descendants of Jeremiah Dial.
Explanation of which David Montgomery is in 1805 Will. If you lookat David Montgomery (younger)
tombstone in Gilders Creek Cemetery you find he was born about 1766 anddied about 1831. He could not possibly be the father of Mary wife ofJohn Dial. In fact Mary would appear to be older than David Montgomery(younger). Again some researcher took a peek at Collisson's notes anddropped the question mark he had left there and made Mary's parents to beDavid Montgomer and Jane Beard. They probably based this assumption onthe name of John and Mary Dial's first born, namely David MontgomeryDial. At best I think Mary could be older sister of David Montgomery butthis I even find hard to believe. But everyone named in this Will hadsome tie to Dial family and possibly there in lies Mary's maiden name.
A look at David Montgomery (older). With the confusion of Marybeing daughter of David Montgomery (younger) and other misinformation Ithink I may be the first person to point out that the researchers haveall been looking at the wrong David Montgomery named in the Will. DavidMontgomery (older) who purchased land with Jeremiah Dial in 1803 and cameto South Carolina on the LORD DUNLUCE with William and Margaret(daughter) is in my mind certiainly the one named in Will.
David Montgomery (older) died in 1808 and another unrelated chain ofevents happened. The land left to Margaret (wife) was deeded or sold toDavid Montgomery Dial and Jeremiah 3. It was almost like the death ofDavid Montgomery released his share of the 100 acres purchased in 1803with Jeremiah. I don't think we will ever know why there was 13 yearsbetween the probate of the Will and the proven date of Will in 1817. Ithink David Montgomery (older) was named as exec. of Will because he wasbrother of wife and related to family. The other David Montgomery(younger) would be at best the brother of Mary (widow) of John Dial andthat seems a long reach to name an exec. of Will.
